Since the Supreme Court struck down the federal ban in 2018, sports betting in the United States has been legal in whichever states chose to allow it: about three dozen, roughly thirty of them online, each with its own regulator, its own tax and its own list of licensed sportsbooks. The same app works in New Jersey and refuses you in Texas. Here is how the market works, and the three books that scored best in our tests with accounts in New Jersey and Colorado.
Each state regulates separately. A sportsbook needs a licence in every state where it takes bets, usually in partnership with a casino or a tribe, and verifies at every login that the customer is physically inside the state, by geolocation on the phone or a plug-in on the computer. Registration asks for the last four digits of the Social Security number beside the usual identity details, and identity is verified against databases at once. California, Texas, Georgia and Florida’s neighbours are the large states still without online betting; the list changes every year.
Winnings are taxable income federally and in most states; the sportsbook issues a tax form for large wins and withholds on the largest, and losses can be deducted only by taxpayers who itemise. Offshore sites serving Americans hold no US licence, break federal payment law when they accept cards, and offer no recourse; they remain popular in the states without a legal market, at the customer’s own risk.
Payments are cards, which some banks decline for gambling, PayPal, online banking through Trustly-style connections, Venmo at some books and prepaid cards issued by the sportsbook itself. Withdrawals took one to three days in our tests; PayPal was fastest, bank withdrawals slowest.
Ranked by our test score. All three are licensed in a long list of states; availability depends on where you are standing.
Licensed in a growing list of states, bet365 brings its live betting menu and streaming to the US market, with early-payout offers on the NBA and NFL and card withdrawals inside two days in our Colorado test.
The daily-fantasy company that became one of the two national sportsbooks: the widest range of props and same-game parlays, a polished app, bonus bets rather than deposit matches, and PayPal withdrawals within a day in our New Jersey test.
The market leader by volume, owned by Flutter, with the cleanest app in the market, an unusually good same-game parlay builder and quick PayPal withdrawals. Prices on the main lines are standard; the strength is the product.
None of the other twenty-one operators in our ranking holds a US state licence. International platforms that accept Americans do so without one; we do not recommend them for US residents.
PayPal and online banking were the fastest ways to get paid in our tests; cards deposit instantly and some banks decline gambling transactions.
About thirty, with more voting every year; the sportsbook’s app tells you at login whether your state is live.
Yes; winnings are income, large wins are reported to the IRS, and losses offset winnings only if you itemise.
It is not licensed, payments to it are legally grey, and there is no recourse; we do not recommend it.
The last four digits are used for identity verification and tax reporting, as the state licence requires.
